Non-MVA Claims

You have been in a serious automobile accident, either as a driver, passenger pedestrian or cyclist.

You have suffered severe injuries, such as a brain injury leaving you mentally incapacitated or a spinal cord injury that robs you of your ability to be fully independent, as you were prior to this automobile accident. Other examples include injuries leading to amputation, or full loss of eyesight.

A person who meets that level of impairment may be unable to resume her/his activities of daily living due to the negligence of another motorist.

In this scenario, you may have suffered one or more catastrophic injuries and impairments consequently. If so, you may have access to enhanced medical and rehabilitation benefits from your own insurer, up to $1,000,000.

“Fortunately, most victims of a negligent motorist will not be catastrophically injured or impaired. Nevertheless, even if you are hurt, you are eligible for important benefits from your own automobile insurer called ‘Accident Benefits’. These include an Income Replacement Benefit, Medical and Rehabilitative Benefits and if warranted, a Caregiver Benefit.

If you are injured, it is very important to seek the advice of your Healthcare Provider (eg. Doctor, Physiotherapist, or Chiropractor) as soon after the automobile as you can.” Once you have sought medical attention, it would be appropriate to seek legal advice.

In the meantime, your own insurer may reach out to you and give you advice regarding treatment.   Be wary if the insurer suggests that you attend at a “Preferred Provider” or insists that you attend there, remember this: you are entitled to attend at the healthcare professional of YOUR OWN CHOOSING.

These benefits are available to any person who is found to have suffered from a Catastrophic Impairment designation, even if that person was the one that caused the accident.

At Flaherty Sloan, we hope that neither you nor your family are victim of an automobile accident leading to a Catastrophic Impairment. However, we are equipped to provide you with the prompt and sound legal advice you need, and lead you to the medical and rehabilitative resources you will NEED to BEGIN your recovery.
